Davao City, January 7, 2025 – The Davao City Police Office (DCPO) has filed formal charges against a businessman for violating the city’s long-standing firecracker ban. The offender, identified as Remegio, also known as “Botyok,” a resident of Placer, Población, Surigao del Norte, is accused of igniting fireworks on January 1, 2025, at Phase 1, Block 4, NHA Bangkal, Davao City. The case was filed at the Office of the City Prosecutor under NPS Numbers XI-02-INV-25-A-0040 and 0041.

The charges stem from violations of City Ordinance 060-02, Series of 2002, and Republic Act 7183, which regulate the sale, distribution, and use of fireworks and pyrotechnics. Evidence against Remegio includes testimonies from two witnesses who saw him lighting fireworks along a riverbank, fragments of fireworks recovered from the scene, and corroborative findings by Talomo Police investigators.

The Public Safety and Security Office (PSSO), led by Angel Sumagaysay, supported the DCPO in preparing the case. “The city has been implementing the firecracker ban for years now to ensure public safety,” Sumagaysay said on Monday.

City Ordinance 060-02, enacted in 2002, strictly prohibits the use of firecrackers in Davao City. Violators face escalating penalties: a ₱1,000 fine or 20 to 30 days of imprisonment for the first offense, a ₱3,000 fine or one to three months of imprisonment for the second offense, and a ₱5,000 fine or three to six months of imprisonment for subsequent offenses.

Authorities reiterated their commitment to enforcing the ordinance, emphasizing that violations will not be tolerated. “This case serves as a stern warning to the public. Compliance with the law ensures peace and order in our community,” the DCPO stated in an official release.

Davao City’s consistent enforcement of the firecracker ban underscores its dedication to public safety and environmental protection. Residents are reminded to adhere to local laws and report any violations to authorities.
